Colorado’s New Website Privacy Law

Colorado has passed a new website privacy law that is designed to protect the privacy and personal information of its residents. How does this affect your Colorado business and website? Let’s find out!

The Skinny On Colorado’s Website Privacy Law

This new legislation (CO SB190) requires your business to have a privacy policy on your website and give customers the ability to opt-out of having their personal data collected or being used to target ads.

What kind of data collection requires a privacy policy? Well, even the basic data most customers fill out in website forms, appointment schedulers, and newsletter signups count.

  • Address

What Businesses Are Affected?

Like all new web privacy laws, CO SB190 doesn’t only affect businesses based in the Centennial State. Many businesses with websites may be affected by this new law across the United States (and even overseas if they collect data from residents in Colorado).

The law applies if you:

  • Conduct business in Colorado.

OR

  • Produce / deliver commercial products or services that are intentionally targeted towards residents of Colorado.

AND if you also hit ONE of the following thresholds:

  • Control or process the personal data of 100,000 or more Colorado consumers during a calendar year;
  • Gains revenue or receives a discount on the price of goods or services from the sale of personal data and processes or controls the personal data of 25,000 or more Colorado consumers.

What Do You Need To Do?

The short answer is to have a privacy policy on your website by the deadline of July 2023. However, you should be very careful about the type of privacy policy you add. Make sure you are covering all the legal requirements and don’t leave any loopholes that could get you in trouble.

Some businesses hire a lawyer to draft their privacy policy and that’s a smart bet. However, you have to update privacy policies for every new requirement that gets created on the state, national, (and sometimes international) level. The laws are changing rapidly. Can you keep up?
