What Businesses Are Affected?
Like all new web privacy laws, CO SB190 doesn’t only affect businesses based in the Centennial State. Many businesses with websites may be affected by this new law across the United States (and even overseas if they collect data from residents in Colorado).
The law applies if you:
- Conduct business in Colorado.
- Produce / deliver commercial products or services that are intentionally targeted towards residents of Colorado.
AND if you also hit ONE of the following thresholds:
- Control or process the personal data of 100,000 or more Colorado consumers during a calendar year;
- Gains revenue or receives a discount on the price of goods or services from the sale of personal data and processes or controls the personal data of 25,000 or more Colorado consumers.
